The BetterMe mobile message service (the "Service") is operated by BetterMe Limited and any of its affiliates (collectively "BetterMe", "we", or "us"). Your use of the Service constitutes your agreement to these Mobile Terms of Service ("Mobile Terms").
These Mobile Terms are supplemental to and do not replace the BetterMe Terms and conditions of use ("Terms") available at https://betterme.world/terms.
In the event of any conflict between these Mobile Terms and the Terms, these Mobile Terms shall prevail with respect to the mobile messaging services only.
Any capitalized terms used but not defined in these Mobile Terms shall have the meanings given to them in the Terms.

1. Consent to Receive Messages
1.1. By providing your phone number and agreeing to these Mobile Terms, you hereby provide your express written consent to receive recurring SMS/text messages, which may be sent using an automatic telephone dialing system, from and on behalf of BetterMe through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list.
1.2. Message frequency varies. BetterMe reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages.
2. Types of Messages
- Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, cart reminders, etc.).
- Promotional messages may include promotions, specials, and other marketing offers.
3. Voluntary Participation
3.1. You understand that you do not have to sign up for this program to make any purchases, and your consent is not a condition of any purchase with BetterMe.
3.2. Your participation in this program is completely voluntary.
4. Charges and Fees
4.1. We do not charge for the Service. However, message and data rates may apply. You are solely responsible for all charges and fees associated with text messaging and data usage imposed by your wireless provider.
4.2. Check your mobile plan and contact your wireless provider for details.
5. Opting Out
5.1. You may opt-out of the Service at any time by texting the single keyword command STOP to +18772177969.
5.2. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you.
6. User Responsibilities
You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

8. Changes to Service
8.1. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes.
8.2. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
9. Changes to Mobile Terms
9.1. If any changes to these Mobile Terms may affect your use of the Service or your legal rights as the user of our Services, we will strive to notify you before the update's effective date by sending an SMS/text message to your mobile number.
9.2. Such updates will be effective no less than 14 days from the date of notification.
9.3. Your continued use of the Service after the effective date of such changes constitutes your acceptance of the updated Mobile Terms.
9.4. Any other changes will be notified to you only by updating the "Last updated" date of these Mobile Terms and you waive any right to receive specific notice of each such change.
10. Liability
To the fullest extent permitted by applicable law, you agree that BetterMe will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
11. Governing Law
11.1. These Mobile Terms shall be governed in accordance with the laws of England and Wales (excluding its body of law governing conflicts of law).
11.2. To the extent that any action relating to any dispute hereunder is for whatever reason not submitted to arbitration, each of the parties submits to the exclusive jurisdiction of the courts of England and Wales to settle any disputes that may arise out of or in connection with this Mobile Terms and that accordingly proceedings must be brought in such courts.
11.3. The parties irrevocably submit to the personal jurisdiction and venue of the courts of England and waive any defenses of improper venue or forum non conveniens.
12. Governing Language
Any translation from the English version is provided for your convenience only. In the event of any difference in meaning or interpretation between the English language version of these Mobile Terms, and any translation, the English language version will prevail. The original English text shall be the sole legally binding version.
